Warranty and Limitations of Liability

Marric Products warrants that the product(s) be free from defects in workmanship and materials, under normal residential use and conditions, for a period of one (1) year from the date of delivery, and provided any defect(s) are not the result of:

(i) improper installation;

(ii) improper application;

(iii) failure to adhere to operating instructions and/or safety precautions;

(iv) customer abuse or misuse;

(v) unless uses otherwise specifically stated and approved in writing by Marric Products for uses other than specifically documented in Marric Products Website.

Marric Products agrees, at its option during the warranty period, to repair any defect in material or workmanship, or to furnish a repaired or refurbished product of equal value in exchange without charge.

Such repair or replacement is subject to verification of the defect or malfunction before allowing or disallowing Buyer’s claim. Defects that do not impair service shall not be a cause for rejection or recovery under any warranty. Buyer assumes full responsibility for the use and application of the product and proof of purchase as confirmed by showing the model number on original dated sales receipt.

In no event shall Marric Products be liable for consequential or indirect damages, for purposes hereof shall include without limitation, loss of use, income or profit, down time or damages due to delay, losses sustained as the result of injury to any person, loss of or sustained as the result of work stoppage, whether by reason of breach of warranty, breach of contract, negligence, strict liability or otherwise, whether foreseeable or not and whether or not Seller has been advised of the possibility of such damage or injury to any person. Buyer shall indemnify Marric Products against all liability, cost or expense, which may be sustained by Seller on account of any such loss, damage or injury.
